Terms of Service

These Terms of Service ("Terms") govern your use of services provided by Horizon Heights Productions ("we," "us," "our"), a drone photography and videography company based in Marietta, Ohio. By booking or using our services, you agree to these Terms.

1. Services

Horizon Heights Productions provides professional drone photography, aerial videography, real estate photography, land aerial mapping, construction documentation, commercial property photography, event coverage, and related media production services in the Mid-Ohio Valley region.

2. Booking and Scheduling

  • Services are booked via phone, email, our website contact form, or our online scheduling system (Square Appointments).
  • A booking confirmation will be sent via email or text with the date, time, location, and service details.
  • We recommend booking at least 1-2 weeks in advance for residential services and 2-3 weeks for events and commercial projects.

3. Pricing and Payment

  • Service prices are listed on our pricing page and may be adjusted for custom projects.
  • A written or verbal quote is provided before any work begins. The quoted price is the final price unless scope changes are mutually agreed upon.
  • Payment is due upon delivery of final media unless alternative arrangements are agreed in writing.
  • We accept cash, credit card, Venmo, and Zelle.
  • Travel fees of $0.73/mile apply for locations beyond 30 miles from Marietta, OH.

4. Cancellation and Rescheduling

  • Client cancellation (48+ hours notice): Full refund of any deposit or no charge.
  • Client cancellation (under 48 hours): A cancellation fee of $50 may apply to cover preparation time.
  • Weather cancellation: If weather conditions are unsafe for drone operations, we will reschedule at no additional cost. We monitor conditions 48 hours in advance and will proactively communicate any weather concerns.
  • No-show: If the client fails to provide access or be available at the scheduled time without prior notice, a $75 no-show fee may apply.

5. Weather Contingency

Drone operations require safe weather conditions. We cannot fly in rain, snow, fog, or sustained winds above 25mph. If conditions deteriorate during a shoot, we may need to pause or reschedule the aerial portion. Ground-level photography can typically proceed in light rain or overcast conditions. Weather-related rescheduling is always free of charge.

6. Image and Video Usage Rights

  • Client rights: Upon delivery and payment, clients receive full commercial usage rights for all delivered media. You may use images and videos for MLS listings, websites, social media, print materials, and marketing purposes.
  • Photographer rights: Horizon Heights Productions retains the right to use select images and videos from completed projects for portfolio, website, social media, marketing, and promotional purposes. If you wish to opt out of portfolio usage, please notify us before or during the service engagement.
  • Third-party licensing: Delivered media may not be sold, sub-licensed, or provided to stock photo/video services without our written consent.

7. Delivery

  • Photo galleries are delivered within 48 hours of the shoot (standard), or 24 hours with rush delivery (+$100).
  • Edited videos are delivered within 3-5 business days (standard).
  • Files are delivered via online gallery with download links. We retain delivered files for 90 days; after that, we recommend clients maintain their own backups.
  • One round of minor adjustments is included at no cost. Additional editing is available at $50/hour.

8. FAA Compliance and Safety

All drone operations are conducted in compliance with FAA Part 107 regulations. This includes:

  • Current FAA Part 107 Remote Pilot Certificate
  • Pre-flight airspace authorization and NOTAM checks
  • Visual line of sight operations
  • Maximum altitude of 400 feet AGL
  • No flights over non-participating persons without proper authorization
  • Compliance with all TFRs (Temporary Flight Restrictions)

We also comply with Ohio House Bill 77 (HB 77) regarding state-level drone operation regulations, including privacy protections.

9. Liability

  • Horizon Heights Productions carries comprehensive liability insurance for all drone operations.
  • Our total liability for any claim arising from services shall not exceed the total amount paid for the specific service engagement giving rise to the claim.
  • We are not liable for delays or failures caused by weather, airspace restrictions, equipment malfunctions beyond our control, or client-side issues (access, preparation, scheduling).
  • Clients are responsible for obtaining any necessary property access permissions and notifying us of any known hazards at the service location.

10. Property Access and Preparation

Clients are responsible for:

  • Ensuring legal access to the property or location being photographed
  • Notifying us of any known obstacles, hazards, or restrictions at the location
  • Following the pre-shoot preparation guidelines we provide
  • Securing any necessary permissions from property owners, HOAs, or venue management

11. Dispute Resolution

Any disputes arising from these Terms or our services shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through mediation in Washington County, Ohio. These Terms are governed by the laws of the State of Ohio.

12. Changes to Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated date. Continued use of our services constitutes acceptance of updated Terms.
